To get a work permit in Vietnam, applicants must meet the following requirements:

Over 18 years of age
โ
Possess suitable technical qualifications, working experience and good health that satisfies the job requirements
โ
Not currently serving a sentence; does not have an unspent conviction; is not undergoing criminal prosecution under his/her home countryโs law or Vietnamโs law;
โ
Be an executive officer or a manager, specialist or technical worker with qualifications and occupational skills
โ
Have their employment approved in writing by a competent state agency
โ
Not enter Vietnam on a tourist visa, except for some special cases permitted by the Ministry of Labor, Invalids and Social Affairs on a case-by-case basis.

A foreign worker may be exempt from Vietnamโs work permit if falling in one of the following common cases:
โ
Being a chief representative or director of a project, or being in charge of operation of a Vietnam-based international organization or foreign non-governmental organization.
โ
Entering and staying in Vietnam for under three months to offer services.
โ
Entering Vietnam for a period of under three months to solve or to adversely impact production or business activities and cannot be solved by Vietnamese experts and foreign experts currently in Vietnam.
โ
Having married a Vietnamese and is currently residing in Vietnamโs territory.
โ
Being the owner or capital contributor of a limited liability company with a contributed capital value of at least VND 3 billion.
โ
Being the chairperson or a member of the Board of Directors of a joint-stock company with a contributed capital value of at least VND 3 billion.

In order to obtain work permits for foreign employees, an employer must carry out two procedures: one for asking for approval of employment of foreigners and the other for application for work permits.
First of all, a report explaining the demand for foreign employees must be sent to the provincial-level Peopleโs Committee chairperson. Later, the employer must send a dossier of application for a work permit as prescribed in Article 10 of Decree 102 (including the written approval of employment of foreign employees) to the provincial-level Labor, War Invalids and Social Affairs Department at least 15 (instead of the current 20) working days before the foreign employee starts working. The Department will give a reply on whether to grant a work permit within 10 working days after receiving the dossier.

A granted work permit would be valid for at most two years and could be extended once for another two years. At least five days but no more than 45 days before the work permit of a foreign worker expires, his employer would have to submit a dossier of application for extension of the work permit to the provincial-level Department of Labor, Invalids and Social Affairs that has granted the work permit.
After having his work permit extended, a foreigner working in Vietnam on a contractual basis and his employer would sign a new labor contract before the date the foreign worker is expected to resume working. The employer would have to send a certified copy of the signed contract to the authority that has extended the work permit.
