Key Human Rights for Property Buyers and Sellers in South Africa

In South Africa, buyers and sellers of property are protected by various human rights and legal provisions to ensure fair and just transactions. These rights are primarily derived from the Constitution of South Africa, the Consumer Protection Act, and property laws that govern real estate transactions.

1. Right to Own and Sell Property
Section 25 of the Constitution protects the right to own, buy, and sell property.
No one may be arbitrarily deprived of property.
Expropriation of land must be just and equitable, with compensation where applicable.

2. Right to Fair and Transparent Transactions
The Consumer Protection Act (CPA) ensures that buyers and sellers receive fair treatment and full disclosure in transactions.
Sellers must disclose defects, and buyers have the right to fair contract terms.

3. Protection Against Discrimination
The Promotion of Equality and Prevention of Unfair Discrimination Act (PEPUDA) prohibits discrimination in property sales based on race, gender, disability, or other protected grounds.
