Visa refused? Watch this!!

Has your visa been refused recently but want to reapply for it? Then watch this video till the end to maximize your chances of approval.

Our client is in the Philippines and had previously lodged a Visitor visa application on his own. That visa was refused. Then he reached out to us. Within less than a month of his visa refusal, we lodged another visa application addressing the issues that were mentioned on his refusal letter. Like in most of the visitor visa refusals, the case officer was not satisfied that our client genuinely intended to stay temporarily in Australia.

Previously he had declared he is a student but had provided only minimal details to substantiate his claims. So obviously this time we worked on making his documents around his enrolment stronger and submitted his confirmation of enrolment, student ID, leave approval letter from his college and college admission certificate.

Similarly, previously he provided financial support evidence from his family members which was not good enough for the case officer. This time around, we showed bank balance under his name, lots of documents proving his employment status and leave approval letter from his employer.

And of course, the visa was approved. Our client was over the moon and gave us a really good google review which you can see in my background.

So, the bottom line is, if your visa has been refused you need to address each reason on the refusal letter carefully and provide plenty evidence to substantiate it.

TAS State Nomination Criteria

If you are thinking about lodging an EOI for TAS state nomination, then watch this video till the end.

There are 2,860 places allocated for this year out of which 2100 places are for 190 and the remaining 760 are for 491. The allocation is double from last year. Tasmania has already received over 1200 registrations this year since 1 August. So, although quota is higher this year, it will be competitive.

Unlike with other states, all occupations on the Australian government’s subclass 491 and 190 Skilled Occupation List are eligible for Tasmanian nomination. Like other states, Tasmania will not prioritize higher score but instead the invitations will be based upon their published priority attributes.

You will be immediately invited to apply for nomination if your employment and skills assessment are related to high priority industries like health/allied health, some infrastructure and engineering and construction roles, education and related support roles and some IT roles.

Talking about nomination requirements, you need to be working in your nominated occupation for minimum 6 months for at least 20 hours per week before lodging nomination application for 190 and for minimum 3 months for 491. For 190 only occupations from skill level 1-3 are considered while for 491 occupations from skill level 4 and 5 with severe labour recruitment difficulty, relevant qualification or experience and endorsed career advancement are taken into consideration

High EOI points but not invited? Here is why?

Have you got high points in EOI but still have not received an invitation? This could be the reason why?

For the year 2024-25, QLD government announced they will not be focusing on points while issuing invitations instead salary, additional work experience, superior English and partner skills would be considered.

Similarly, Victorian government instead of the EOI points, will be focusing on factors like age, English language level, years of experience, Occupation skills level, Education level, Partner’s skill level and annual earnings from Victorian employment.

Tasmanian government also announced they will be issuing invites based on priority attributes.

Looks like all the states will be following in the same footsteps and will not be relying just on the EOI points so please work on enhancing you ranking.

QLD State Nomination Criteria

If you are thinking about lodging an EOI for QLD state nomination, then watch this video till the end.

There are 600 places allocated for 491 and 600 places for 190 for the year 2024-25.
Just bear in mind the nomination program for QLD is not open yet and hence the criteria are not available. But you can prepare yourself in advance.

QLD government will not be focusing on points while issuing invitations instead salary, additional work experience, superior English and partner skills would be considered.

Talking about eligibility criteria for QLD nomination, for both 491 and 190 visas you need to have an occupation on the list and Proficient English meaning 7 in each band in ILS.

For 190, you must have worked for at least 6 months minimum 30 hours per week in QLD before applying and must also have ongoing employment for a further 12 months after EOI lodgment. The focus would be on sectors like Energy, Construction and Health.

For 491, you must have worked for at least 3 months minimum 30 hours per week in QLD before applying and must also have ongoing employment for a further 6 months after EOI lodgment. The focus would be on Energy, Construction, Health, Education, ICT, Agribusiness, Tourism and Transport.

SA State Nomination Criteria

If you are thinking about lodging an EOI for South Australian state nomination, then watch this video till the end.
For onshore applicants, there are 464 occupations available and 3 streams which are for applicants who studied in SA, for people currently living in SA and working in their nominated occupation and for people who are living in outer regional areas of SA and working in their nominated occupation.
There are also 427 occupations available for Offshore people. If you are a skilled migrant currently living offshore, who has submitted an EOI using the SkillSelect system, you may be selected by South Australia and invited to apply for state nomination.

Talking about nomination criteria, similar to other states you need to have lodged an EOI on SkillSelect, your occupation needs to be in SA’s skilled occupation list, need to have been residing in SA for at least last 12 months and have been working for the last 12 months in a FT job and the job must be related to your nominated occupation. In terms of English requirement though most occupations need only competent English, if your occupation requires registration or licensing, you will need to ensure you meet the English requirement set by the registration or licensing authority. A good example of this is a Registered nurse. Registered nurses need proficient English for registration and hence they need the same level of English to be eligbile for SA nomination.

VIC State Nomination Criteria

If you are thinking about lodging an EOI for VIC state nomination, then watch this video till the end.
Victoria has 3000 places for 190 visa and 2000 places for 491 visa for the 2024-25 program.
The steps to apply for Victorian nomination program are: first you check your eligibility against 190 or 491 visa requirements, you then submit your EOI visa Australian Government’s skillselect. Using the EOI number your then submit your ROI on the Live in Melbourne portal. Once you are invited you submit your nomination application in the Live in Melbourne portal and after your nomination application is successful then the last step is to lodge your visa application with the Department of Home Affairs.

If you are aiming for 190 visa, you must be living in Victoria or overseas. You are not required to be working to be eligbile for 190 visa but if you work in skilled employment meaning in any role that is at skill levels 1,2 or 3 in the ANZSCO classification then your ROI might be prioritized. For example, Cook is Level 3 and Chef is level 2 occupation and both are considered skilled employment in Victoria.

If you are aiming for 491 visa you must be living and working on regional Victoria or living overseas. Some outer suburbs of Melbourne are considered regional for the purposes of migration by the Department of Home Affairs.

As an example, the Mornington Peninsula, Pakenham and Geelong are considered designated regional areas of Victoria for migration purposes.

If you are living in regional Victoria, you must be working in skilled employment for an employer physically located in regional Victoria.

WA State Nomination Criteria

If you are thinking about lodging an EOI for WA state nomination, then watch this video till the end.
There are 3 streams in WA state nomination program. To be eligible across all 3 streams, you need to have a nominated occupation on the relevant list and score at least 6 in each band in ILS. Apart from this, you also need to have at least one year Australian or overseas work experience in your nominated occupation to be eligbile for WASMOL schedule 1 while you need a full-time contract in WA for a minimum of 6 months in the nominated occupation to be eligbile for 190 visa. For 491 visa there is no need of a work contract.

Candidates residing in WA get the highest priority as well as occupations in sectors like building and construction, healthcare and social assistance, hospitality and tourism and education and training are being ranked highly currently.

How to prepare documents for Partner visa

If you are thinking about applying for a Partner visa, then this video is for you. We will discuss about the documents required for a successful partner visa application.
Basically, the immigration department will assess a partner visa based on 4 pillars of the relationship.
The first one is obviously your finances. You need to show evidence that you and your partner share financial matters. For this, you can submit documents like joint mortgage or lease documents, joint loan documents for major assets like homes, cars or major appliances, joint bank account statements, household bills in both names, etc.

The second pillar is your household. You need to show evidence that you and your partner share domestic matters. Evidence can include: a statement about how you share housework, household bills in both names, mail or emails addressed to you both, documents that show joint responsibility for children, documents that prove your living arrangements.

The third pillar is Social matters. You must provide statements from 2 witnesses who are 18 years old or older, know you and your spouse or de facto partner and know about your relationship. You can also include joint invitations or evidence you go out together, proof you have friends in common, proof you have told government, public or commercial bodies about your relationship, proof you do joint sporting, cultural or social activities together and proof you travel together.

The fourth and final pillar is Commitment. You need to provide evidence you are committed to a long-term relationship with each other. Evidence must how that you have knowledge of each other’s background, family situation or other personal details, have combined your personal matters, stay in touch when apart, are not related by family. You can also provide the terms of your wills as evidence.

We just got an email from South Australian State government announcing that they are now open for taking ROIs for the 2024-25 program.

There are place available though Onshore and Offshore programs.
There are 464 occupations available for the onshore streams. Eligible onshore applicants who meet requirements can now submit a Registration of Interest (ROI). Prospective migrants residing offshore with skills in high demand in South Australia will be considered from their SkillSelect EOI and if successful, they will be invited to apply for South Australian nomination. There are 427 occupations for offshore stream.
There is no fee for submitting an ROI.

Victorian ROI is open

We just got an email from Victorian State government announcing that they are now open for taking ROIs for the 2024-25 program.

To register your interest for Victorian nomination, you must:
1.meet the current eligibility requirements,
2.have an up to date and accurate SkillSelect Expression of Interest (EOI), and
3.submit a new Registration of Interest as all Registrations of Interest submitted in previous years have expired.

There is no cost for submitting a Registration of Interest or a nomination application.

The Government has introduced new reporting protection pilots to encourage early reporting and resolution of workplace exploitation claims.
If you have been exploited in your workplace, you can lodge an application for Workplace Justice visa which comes under SC 408 visa. This visa allows you to stay in Australia temporarily for up to 12 months. You can include your family members in this visa and there is no visa application charge. You must provide certification from a participating government agency or an accredited third party. This must explain why it is beneficial or necessary for you to stay in Australia to pursue your workplace exploitation claim.

Types of workplace exploitation may include:

- underpayment of wages
- pressure to work more hours than your visa conditions allow

Co-spec labour agreement

In my previous video I talked about how you need to do a company specific labour agreement if you are an NDIS provider and want to sponsor your employees on 482 and 186 visas.

Let’s look at the eligibility requirements as an NDIS company:
1. You must be an Australian registered business with good standing
2. You will need to demonstrate that you will be able to meet the salary and employment condition requirements. The minimum salary is set at $70,000 per year.
3. You must demonstrate that there is a genuine labour market need to utilise the labour agreement program, evidencing that the relevant position/s are unable to be filled through the local labour market
4. You must not have more than 30% overseas workers in your company if you are in Sydney, Melbourne and Brisbane and not have more than 50% overseas workers if located outside these cities.

For you to qualify as a Disability Services officer, you need to have Advanced Diploma or Diploma in Disability Support and the tasks you need to perform need to align with the tasks on my background.
If you only have a Certificate 3 or 4 in Disability support and your tasks align with the tasks on my background, then you are classified as an Aged or Disabled Carer. This means it is more complex for NDIS providers to sponsor you. You either need to access DAMA if available in your area or do a company specific labour agreement.
