Couple wins battle with windows and doors company thanks to MyFrenchVA

When Anne and Alistair ordered windows and doors for their new home in France, the company gave them a guaranteed 40-day delivery.

However, after placing the order with their local store, the company advised them that delivery would be much later… around three months! This was a huge problem for the couple, as they were due to move out of their existing property into their new home, a renovation project. It was essential to have the windows and doors fitted before – but the company was refusing to budge on the timescale. Anne and Alistair phoned and visited the retail outlet to discuss the issue – yet to no avail. Company representatives were both defensive and evasive.

Colin and Katy moved to South West France just before the UK left the EU in December 2020 😮. Since 2021, registering a vehicle in France has become more complicated with extra paperwork 📄. To resolve the situation quickly, Colin turned to Martin Swanson of MyFrenchVA.

Crit'Air is a French environmental label that was introduced in 2016 to help reduce air pollution in cities. It is a sticker that must be displayed on all vehicles in certain cities in France, based on the emission category of the vehicle. The sticker ranges from Crit'Air 1 (the green sticker, the least polluting) to Crit'Air 5 (the black sticker, the most polluting).

Cities in France with low air quality can impose temporary restrictions on certain categories of vehicles during periods of high pollution. These restrictions can range from a ban on certain vehicle categories during specific times of day, to a complete ban on all vehicles except those displaying a Crit'Air 1 sticker.

Penalties for not displaying a valid Crit'Air sticker can range from a fine of up to €135 for cars to €750 for commercial vehicles.

Autoentrepreneurs and the letters EI – what changed on the 15th May 2022.

On the 15th of May 2022 a new law came into effect to offer Autoentrepreneurs (Sole Traders) protection for their personal assets from creditors.

Until that date, creditors could attach their personal assets (with the exception of their primary residence) to settle any debts. Typically autoentreprenuers opted for the EIRL (Entrepreneur Individuel à Responsabilité Limitée) for such protection.

Today, every Autoentrepreneur has to add EI (Entreprise Individual) to:
- The name of their bank account (First Name, Last Name, EI)
- Website
- Order Forms
- Quotations
- Invoices
- Adverts
- Business Stamps

If you are an autoentrepreneur and your bank account name doesn’t include the letters EI – you could face a fine of € 750.

Getting French Nationality has never been easier if you are a freelancer.

The French government loves taxes and what better way to get more of them than by inviting entrepreneurs to come live and work in France (and pay local taxes).

So if you are a freelancer with clients anywhere in the world (including France) and earn a minimum of € 15631.75 net per annum after business running costs and taxes you are eligible for a Long Term Stay Visa with the mention "entrepreneur/profession libérale".

After 5 years you can apply for residency and citizenship.

President Macron has chosen Élisabeth Borne as his new prime minister.

Ms Borne is the second female prime minister France has ever had. Her appointment just before the legislatives is a strategic move by Macron to shore up votes under threat from a uniting left under Melenchon. Unlike the previous two Prime Ministers who were rooted in the right of French politics, Ms Borne comes from the socialist left.

She has already held the posts of Minister of Labour, Employment and Economic Inclusion and has some wins in negotiating with the trade unions. She has also served as Minister of the Ecological and Inclusive Transition and Minister of Transport.

In France, you are given 12 points on your driver's license. Keeping them very much depends on your behaviour.

The maximum you can lose for a traffic violation is 6 points but if you have been particularly badly behaved they can add another 2 points for another violation made at the same time or simply revoke your license. Think chatting on your mobile phone and going 50km/h above the speed limit.

The good news is that if you have lost points, they are recuperated automatically after a certain length of time depending on the violation committed and if you haven't committed a new violation in the meanwhile.

You can also take a "stage de recuperation de points" which allows you to recuperate 4 points. The "stage" lasts 14 hours and is normally taken over 2 days and costs about € 250.

It was a pleasure to intervene on behalf of this client between two French artisans on the French Riviera. Instead of sending off emails or letters, a couple of calls was all it took to resolve the situation and set everyone off on the right track with clear deliverables and project timeframes.

A registered letter sent to both parties (with their permission) helps to record what was agreed and keep matters clear.

French beach flags have changed this summer. The shape has changed from a triangle to a rectangle.

The previous blue triangular flag which designated the supervised bathing zone has been replaced by a red and yellow rectangular flag.

The last change to the regulations concerning beach flags was in 1962.

The French government has classed 126 communes in France as a priority in the face of increased coastal erosion due to rising waters and climate change.

The mayors of these communes have to draft a 30 - 100 year zone at risk profile wherein all construction will be banned for the next 30 years and certain buildings earmarked for demolition within the next 100 years.

Not so great for those with coastal villas in these zones.

From 2025 it will be illegal to rent out badly insulated properties in France.

In 2025 all category G properties are affected.
In 2028 all category F properties.
in 2034 all category E properties.

So if you are thinking about buying to let in France - best to consider the new law.

My name is Florence Swanson and I was born and raised in Lyon, France. I have lived, worked and studied in Manchester, Barcelona and Cape Town, allowing me to learn what it is like to be an expatriate in a foreign country. I am married to a South African (yes really!) and from 2004 – 2011 I co-owned and helped run the AngloINFO Dordogne, Limousin and South Aquitaine websites.

I have first-hand knowledge of starting and running a business in France as well as being blessed with 3 children who are now in the French school system.
