As part of our work permits breakdown series, today we are outlining the Dependant/Partner/Spouse Employment Permits 💍

This permit allows a dependant, partner or spouse of a Critical Skills Employment Permit holder to apply for their own Irish employment permit. A key attractive element of this work permit is that all jobs/occupations in Ireland are eligible.

Criteria for this work permit include:
- The Department of Justice and Equality must determine that you are a dependant of a Critical Skills Employment Permit holder, or of a Researcher on Hosting Agreement.
- The dependant must have been continually living in the Republic of Ireland since arriving.
- The applicant must not be pursuing full-time education.
- The applicant must be living with the Critical Skills Employment Permit holder, or the Researcher.

Are you finding it difficult to understand the many options there are surrounding Irish employment permits? We're here to help! 🤝

Starting from today, we will be posting daily with a summary of each of the nine permits available. First up is the General Employment Permit.

Irish General Employment Permits are used by the state to attract foreign nationals to work in Ireland in occupations which are experiencing a labour shortage. All occupations (except those listed on the Ineligible List of Occupations for Employment Permits) are eligible. Typically, a General Employment Permit can be issued for a two-year period, and can then be renewed for a further three years.

Eligibility criteria for this work permit include, but are not limited to:
- Minimum annual salary (typically greater than €30,000).
- Occupation cannot be listed on the Ineligible List of Occupations for Employment Permits.
- The prospective employee must possess the relevant qualifications or experience required.
- The prospective employer must be registered with the Revenue Commissioners & the CRO.
- The prospective employee must be employed & paid directly by the prospective employer.

We conduct a company/ employer audit service to ensure compliance with Employment Permit Legislation and the Regulations as they are amended by the Minister for Business, Enterprise & Innovation.

The audit is undertaken and an assessment provided based on the information supplied by an employer which will outline the value of the information regarding the legitimacy of documents and information provided to the employer.

In December 2022, the Irish Government agreed that a single application procedure for employment permits and immigration permissions should be developed. It was also agreed that an Inter Departmental Working Group should be established to develop an implementation plan for consideration by Government.

The primary objective of this new Working Group is to simplify the procedure for third country nationals wishing to migrate to the EU legally for work processes, through a single application procedure for a combined employment and residence permit.

There are a number of requirements for employers who want to employ people who need employment permits which must be met.

1) They must be legally trading in Ireland, meaning that they must be registered with Revenue & with the Companies Registration Office (this can be checked on cro.ie).
2) The employer must employ the individual directly (i.e. applications from recruitment agencies, agents, intermediaries or companies who intend to outsource or subcontract an individual are not accepted).

A number of changes to the Atypical Working Scheme came into effect on the 1 January 2023, see more detail below:

- Permission under the Scheme will continue to be granted for a period of 90 days.
- The 90 days of permission under the Scheme can be used to support intermittent travel into and out of the State to a maximum of 90 days over a 6 month period.
- A cooling-off period of one month will apply from the end of the 6 month period before any new entry to the State under a subsequent AWS permission can occur.
- A new application can be made during this one month period, but the permission granted cannot be used until the month has passed. This will be identified on any subsequent permission letters granted.
- The granting of any subsequent permission under the Scheme will be contingent upon demonstrated compliance with the terms of the previous permission and that responsibility fo demonstrating same rests solely upon the applicant or their agent in the form of evidence of landing and remaining in another jurisdiction by means of passport stamps.
