Some useful information for those served with termination notices.

Even if your landlord has given you a valid termination notice, he cannot evict you without making an application to the RTB for overholding. You are allowed to remain in the property while the case is going ahead. This can be for a number of weeks, or even longer. The RTB will only issue an order for you to leave the property if they find that the notice is valid and all required steps have been followed. There are lots of technical reasons why a notice may not be valid. The RTB adjudication process is confidential and there is no penalty for engaging in it.

If the RTB issue a decision after the first stage you have the right to appeal this to a Tribunal. This can take a further number of months to be completed. You are allowed to remain in the property while the case is being heard. Tribunal hearings are public hearings and your details can be published on the RTB website once a decision is made. However, it is also possible to reach a confidential settlement with your landlord at this stage. Again there is no penalty for engaging in the RTB process, but there is a fee to lodge an appeal.

If the RTB reaches a final determination in your case, you do have the right to appeal this on a point of law to the High Court. If you do not appeal, and if the landlord wants to enforce the order, he must apply to the District Court to do so. The District Court will usually confirm the order of the RTB, and can award the legal costs of the case against you, but the court should listen to you and fully consider your circumstances before making any order. It may be possible to persuade the court to issue a stay on any enforcement of the order. Enforcement of any District Court order should be done through the Sherriff’s office.

At any stage of the process if you decide to leave the property, you can ask the council for emergency accommodation. There is likely to be pressure on the availability of emergency accommodation in the months ahead and there is no guarantee of the standard of accommodation or where it will be located.

We encourage anyone facing eviction to contact CATU for support. Only by standing together and organizing do we stand a chance of stopping evictions.

The above is intended as general information and does not constitute legal advice.

There are 25 households (that we know of) in the Inchicore and Kilmainham area right now facing eviction into homelessness. There are 6 local members who faced a brutal illegal eviction in December- through pressure on the landlord and community pushback they are still in their home.

If they had any sense, the Dáil would vote to extend the ban on evictions to protect tenants. But whatever the outcome today in Leinster House, your union will fight evictions. Even before the ban, the strength of landlords in Ireland has displaced so many people. Varadkar has said that a ban on evictions doesn't matter as most people will find alternative accommodation - this is totally heartless and ignorant. None of the tenants facing eviction in our area have had any luck finding another home - what are tenants supposed to do? We say - get organised and resist. Join your local tenants union and support one another

Gardai shut down stall giving food to Dublin's homeless

**The group, March for the Homeless, said what happened was “heartbreaking”, leading the minister with responsibility for solving the crisis to say that groups like theirs should be “facilitated” in continuing their work.
As the latest homeless figures show 120 people sleeping rough on the streets, Environment Minister Alan Kelly called for “common sense” on the issue of permits for volunteers trying to help them.
March for the Homeless volunteers were back on Grafton Street last night in defiance at the order from gardai to pack up and leave over the weekend.
“We won’t be going anywhere,” organiser Darren Bradley told the Herald.
Stark
Last night on Grafton Street gardai approached the group and asked Mr Bradley to move a van that was parked nearby.
However, the volunteers were allowed to set up the kitchen and serve food.
It was a stark contrast to the weekend, when Mr Bradley said officers told his colleagues to shut down the stall for “health and safety reasons” as homeless people queued for food.

“They took volunteers’ names and addresses, which really shocked me, and told them never to come back,” he said.
He said they should “concentrate on drug dealers and not on people doing good. It’s heartbreaking.”
Mr Bradley said the group normally give out meals like chicken curry, spaghetti and sandwiches as well as toiletries, clean clothes and sleeping bags.
“The homeless people were left without food. If we were selling food I’d understand, because we would need a permit, but we’re giving it away for free.”

A Garda spokesman said that officers were called to Grafton Street where a temporary structure was set up, adding that “it was attracting a significant amount of people”.
“Those involved in setting up the structure did not have permits from Dublin City Council and were asked to remove the structures on the grounds that they were causing an obstruction and were a safety concern.
“We would ask anyone who wishes to set up structures on streets in the city to liaise with Dublin City Council,” he said.
Minister Kelly responded to the incident by saying: “I think people who are doing work like that should be facilitated. Certainly, I feel a bit of common sense should come in here when it comes to the issue of permits.”
March for the Homeless hit the headlines last week when one of its volunteers, Sarah Jane Curtis (19), brought homeless man Adam Skinner (21) to her Debs. Separately, Dublin Simon Community’s Sam McGuinness said that government interventions have had no impact on the homelessness crisis.

He was speaking as he launched the charity organisation’s annual report. Their latest figures show that 120 people were sleeping on the capital’s streets on Monday night. Another 50 people sheltered at Simon’s night cafe.
“The numbers speak for themselves and clearly (State) interventions to date have not been effective,” he said, with the situation being described as a “humanitarian crisis”.
“We are now faced with a catastrophe where, nine months on from the tragic death of Jonathan Corrie in front of Leinster House, the numbers who are rough sleeping have grown – despite the provision of 207 extra beds over Christmas last year,” said Mr McGuinness.
Humanitarian
The organisation assisted more than 3,000 men, women and children across Dublin, Wicklow, Kildare and Meath in 2014.
