Yet, the Miami-Dade SAO cleared Rosemond DESPITE all the evidence they had showing Rosemond killed this unarmed man who was not a threat of serious bodily harm or death to anyone, and published a repeatedly FALSE Close-Out Memo distracting the public from the fact that in almost THIRTY YEARS the SAO has only charged ONE officer in the shooting or killing of anyone and that was a shooting not a killing, and that even the eyewitnesses stated Antwon Cooper was NOT armed! The family of Antwon Cooper -- an unarmed black man shot in the head and killed by black Miami PD SGT Constant Rosemond March 8, 2022 and wrongfully exonerated by a State Attorneys Office which has only charged one officer in police shootings in approximately 30 years --- is deeply moved and in fervent prayer for the family of Tyre Nichols. These mothers of the movement should not have to exist, because in every instance their sons should not have been killed by police. The disdain for black lives -- regardless of the race of the officer -- comes from a long history of systemic racism against black people going back for years. Police brutality as this nation witnessed with Trye and so many other black men and women is the common experience of black people with police. It is now only because cellphone videos, body worn cameras, and other public surveillance exist that the world at large can now see it as well.

As we move into this Black History Month, we ask that EVERYone - regardless of race -- stand against this unlawful killing of black men and women by police. Here in Miami-Dade, our fight remains against a substantively and repeatedly untrue and misleading red-herring Close-Out-Memo put out by the elected SAO exonerating Rosemond's killing of unarmed Antwon Cooper, but stand with us to demand SGT Rosemond be charged. Stand Strongly. Stand United. Make your Voice Heard. Do not Relent. Make sure that everyone knows that "we hold these truths to be self-evident that all men are created equal" applies to black folks as well. The Time To Stop Killing Us Is Now.

It's not just happening in Memphis, but right here in Miami Fl a black male Miami PD SGT Constant Rosemond killed unarmed with one bullet shot to the head 03/08/22 at a traffic stop initiated by a white officer (Ofcr Gonzalez). The bodycam does NOT show Twon with a gun or ANY weapon. Gonzalez stated HE didn't see Twon with a weapon; discard a weapon; or a weapon fall from Twon's large jersey/basketball shorts during their entire encounter. The SAO's office admitted they didn't see Twon with a weapon. Yet, the Miami Dade SAO cleared Rosemond, who drove up on the scene where Cooper was trying to flee and shot him in the head and killed him with one shot!

The SAO then put out a Close-Out Memo 12/09/22 so full of legal holes and non-facts based on the evidence that you could drive a mac truck through it. They kept putting out the red herring about a "gun nearby" on the scene although they couldn't state how close "nearby was" when I asked at their office on 01/04/23. Although admitting they didn't see Twon with a gun or using a weapon against Gonzalez on body-worn camera and the eyewitnesses did not see him with a gun, they still misled the public by stating Twon "discarded a gun" as a fact, and produced a low-partial-match DNA to a gun later on. As matter of fact, when I asked why the gun they kept showing was so far away from where Rosemond shot Cooper in the head and killed him with one shot, the SAO's office ACTUALLY stated that Cooper GOT UP after being shot in the head with a bullet that went through one side of his head and came out the other side, and WALKED SEVERAL FEET to where he then collapsed. As you can in this picture of the scene , there is no blood trail from where he was shot. The eyewitness stated Twon immediately went down when shot in the head and stayed there. As a matter of fact, per their own report, Gonzalez stated the first time he ever saw the "gun nearby" on the scene was after SGT Rosemond had shot Antwon Cooper. I know it's hard for you to see a gun in this entire picture: that's the point. You can see Twon's body; the red car he was driving; his two shoes by the car from he and Gonzalez came forward when Twon tried to flee and Gonzalez reached out and grabbed him and they fell. The truth is that Cooper was unarmed when SGT Rosemond shot him no matter how you slice that report.

And line after line, precept upon precept, there are so many holes and assumptions or conjecture stated as facts; from stating Cooper was "speeding" although they later admitted to us no radar gun or any test/check of his speed was ever done; to the wrong day of the week for the killing; to outright falsely stating Rosemond gave Cooper "several commands" and that Cooper did "not comply" before killing Cooper. The family and I went to their office and we watched the body-worn camera together and they could NOT show us the "several commands." What they could show was what everyone had already seen on the news: at the SAME time Rosemond yells' "get down" he simultaneously shoots Antwon Cooper in the head. EVEN MORE, in their own report they have Officer Gonzalez' statement that EVEN OFFICER GONZALEZ heard a "male voice" but couldn't understand it and didn't even know Rosemond had come on the scene of the traffic shot. So seeing that Cooper and Gonzalez were the exact same spot, when I asked how they stated Cooper -- who is dead so he couldn't have given them a statement -- knew what Rosemond said and understood, when the only other police officer on the scene said he couldn't' understand him, they didn't have a answers. Yet, you see that false statement in still in their published report. When they tell you in the close-out memo that the only eyewitness besides Ofcr Gonzalez - passenger Rodney Bullard -- "gave" a statement what they don't tell you is that other officers responding after Gonzalez called for medical assistance for Cooper who had been shot by Rosemond, pulled Bullard --an innocent bystander --out the car at gun point, handcuffed him; put him in the back of police car for HOURS; then took him to the police station to "give" a statement in the back of their police car; then had police, Detectives, and Prosecutors there to "take" his statement! HE. WAS. PETRIFIED! You won't see any of that in their statement. The list goes on and on; yet the SAO still has that same statement posted to justify not charging SGT Rosemond. So when you get Thirty years of not charging officers in shootings but once, you keep getting more officer-involved shootings and killings of us.

The truth is Rosemond shot an unarmed man. The truth is he should have been charged. The truth is our State Attorney in THIRTY YEARS has only charged ONE officer in a Police SHOOTING. Are you seriously telling me that EVERY officer who shot someone or shot and killed someone was justified for 30 years except one? The truth is the Close-Out Memo entitled "Summary of Facts" is not factual. The truth is until we hold this State Attorney's Office and Miami PD accountable, they will KEEP killing our unarmed black men because they know they will not be charged. Notice that the press conference announcing charges are not for shootings -- except that one. It is time for us to stand up and be counted. Our lives are not target practice for the police. Whether the officers are white or black, the time to stop killing us is now. Contact the State Attorneys Office and let her know you want SGT Rosemond arrested!! She is an elected official: we have the right to demand that do their job and stop running from charging officers in officer-involved shootings. If what we'd seen had shown what the SAO stated in their memo, we would admit that. We are not anti-police. But we are ant-lynching of black people. We are anti-killing of our black men. We are anti-sit-down-and-shut-up-and-don't-speak-up. Make YOUR Voice Heard! If you don't want another Memphis; If you don't want another Antwon Cooper; if you don't want another McDuffie....Let YOUR voice be heard!

In response to the SAO's Close-Out memo that it is not charging SGT Constant Rosemond for his killing of Antwon Cooper on March 8, 2022:

Early in this investigation, we stated to the FDLE our concerns that SGT Constant Rosemond's unlawful killing of Antwon Cooper would be swept under the rug, and that SGT Rosemond would not be arrested or held accountable.

So the tragedy here of the State Attorney's actual refusal to charge is at LEAST two fold:

First, there are the overwhelming substantive and substantial fundamental probative and relevant inconsistencies of its decision not only with the law and actual physical evidence, but the material facts and testimony in its own investigation. We won't point those out now because we don't want SGT Rosemond to shore up his testimony before he has to answer us under oath in federal court, but there is no way based on the facts and physical evidence in the SAO's possession that the SAO didn't have probable cause to arrest him, and enough evidence to convict him. That evidence will come out in court.

Second, to add insult to injury, is the fact that although the Close-Out Memo shows the SAO's office made this decision on 12/06/22, the SAO signed it 12/09/22, and released it publicly by 12/19/22, and although I was in contact with the SAO in behalf of the deceased victim's family from the time the SAO received the investigation file from FDLE on 10/08/22 to discuss the investigation with the SAO's office and meet with the victims, we only learned of the SAO's decision when the PRESS contacted me yesterday, 01/04/23, for a response to the SAO's December Close-Out Memo and decision, of which the SAO never informed us it made. So last night, I had to hurriedly meet with the family to inform them after the press already had the story, after this family had patiently cooperated with the SAO"s office by waiting to meet with the SAO as instructed prior to the decision.

And to add insult to the insult already added to the injury, a week prior to the SAO making that 12/06/22 decision and releasing it, the SAO's office responded to my status check on 11/28/22 that it was still working on the decision, with delays being caused by short-staffing in their office.

So in closing, the family has No Trust in the SAO or its decision. The decision is fundamentally contradictory to the overwhelming evidence and law, and blatantly draws uncorroborated assumptions to exonerate this officer that not even a preponderance of the evidence could support as reasonable inferences.

Justice Called and was Unanswered by the SAO.
We cannot allow that phone to keep ringing.

We will proceed with federal suit against SGT Constant Rosemond and the City of Miami.
