I know we keep harping on this, but the Office of Civil Rights stated publicly they were going to keep releasing to the public information regarding settlements against health care facilities and doctor offices for not cooperating or dragging their feet regarding the timely release of patient records until doctors start following the law!

You CANNOT withhold release of records due to a patient owing you money!!

That is against the law!!

And you better have a VERY good reason if it takes you more than a few days to get a patients’ records transferred to another doctor or other instruction the patient has given you.

The OCR is now up to 44 complaints that have resulted in paid fines, that they have released!

One office has a $15k fine, but most have been $100k+!!!

On top of this we have the new 21st Century Cures Act that has even more strict rules regarding release of information.

I don’t know about you, but I hear from doctors all over the country who receive calls from people stating 'they are from Medicare’ and request documents on patients or confirmation that someone is a patient, and they don't know how to respond.

Even when it is known to be a valid request - how big of a risk or threat is it - how high should your alarm level be?

The Office of Civil Rights (OCR) received over 34,000 complaints in the last year.

HIPAA and Civil Rights Complaints are so backlogged, that
the OCR, who enforces HIPAA, was forced to create a new, expanded, enforcement division.

But wait…

NOT JUST HIPAA!

Last October the government started enforcing NO Surprises Act and 21st Century Cures Act!

We have been warning for over a year (when these laws first
came out) to NOT BE FOOLED if you did not hear much
about these new laws right away, as they would not start
enforcing them for a year or so…

Here they are, and we are now hearing from chiropractors in trouble!
