These are the arguments that the board suggest make the geophysics registration unnecessary.
Most geophysicist reports are utilized by other scientists, geologists, or engineers. Geophysicists rarely interact directly with the public.
We often do UST evaluations, landfill studies, seismic surveys, and rebar scans for private parties. If we work for said scientists, does that mean that they take responsibility for the product of their geophysical contractors?
Additionally, the majority of the complaints the Board receives relating to the practice of geophysics are from PGps against unlicensed individuals who appear to be offering geophysical services through websites or other advertisements.
It seems to me that the board does not want to go after people advertising these services even if they are not qualified. Does this mean that if unqualified firms can advertise engineering/land surveying/geotechnical/environmental work even if they do not employ registered individuals just because they are from out of state?
I am sure many out of state companies employ California Professional Engineers and Geologists.
The cases rarely involve evidence that the unlicensed individuals have actually performed work for consumers in California or that they performed work in a manner that poses a threat to the health, safety, welfare, and property of
the public.
Many of these companies do not use standard of practice equipment or training for their crews. That gives our industry a bad name and is most definitely a safety hazard. A missed UST or utility could definitely harm the public.
Many of the firms advertising these services are located outside of California. As mentioned previously, the practice of geophysics is regulated in only two states.
Would we want to compare California to other states? We have our own CALOSHA too. We hold our state to a higher standard, why would we lower our standards?
Many of these unlicensed individuals are not aware that the services they are offering nationwide are regulated in California.
The job of the board is to make them aware. When working in other states that require a business license, you get a business license for that state.
Based on the information obtained from the complaint history, there does not appear to be a threat to public safety.
It will only be a mater of time before someone gets seriously injured or a building is seriously compromised. If a UST is missed, a gas line goes undetected, landfill limits are not properly delineated, post tension cables are not marked correctly, or seismic parameters are wrong, contractors can get killed during drilling and excavating, buildings can be built over landfill materials, or improper site characteristics can cause improper construction in seismically active areas.
We have seen all of these situations and we have been called out to re survey sites originally surveyed by said out of state companies.
