Due to the situation in Ukraine, there are a lot of questions about how to get asylum in Canada.
ā
ā There are two categories of refugees:
ā
ā¼ conventional refugees - those who are in danger of persecution (mass) or military action
ā¼ persons in need of protection - those who are personally at risk
ā
Way two:
ā
ā¼ The Refugee and Humanitarian Resettlement Program is a long and complicated way, I will not consider it
ā¼ In-Canada Asylum Program
ā
To become a refugee under the second program, you must fly to Canada, for example, on a tour. visa (in Ukraine they are approved quickly, but planes do not fly now) and apply for asylum right at the airport. You need to contact the officers of the Border Guard Service (CBSA) or the employees of the Ministry of Immigration (IRCC).
ā
The case is checked by an immigration officer, then it is transferred to the Immigration and Refugee Board of Canada (IRB). You will be given 15 days to collect documents. If you qualify, a hearing will be scheduled. The Refugee Protection Division (RPD) considers each case individually!
ā
The process takes from 60 days to several months, during this time social services are provided. support. If the decision is positive, the person remains in Canada, receives assistance from the state and can apply for permanent residence. In case of refusal, you can appeal or go to court, but if you lose, you will have to leave Canada š«
ā
I have always advised using the regular immigration programs, but if you choose asylum, be well prepared. Be prepared to answer questions from officers and collect any evidence that it is dangerous for you to be in your homeland.
Now some Canadian politicians are calling on the government to introduce a separate flow for Ukrainians,as was the case with the resettlement of people from Afghanistan. Perhaps this will happen, but it is not yet clear. I will say right away: our company does not work with refugees.
