Tanong ng isang nagPM sa ating page:

Paano ang paglilipat ng titulo ng nabiling lote mula sa isang subdivision project na nagbebenta ng "raw lots" na nabili nila sa isang online offer sa pamamagitan ng straight installment na pagbabayad?

Sagutin natin ito ayon sa elemento ng Real Estate Practice:

Raw Lots - ito ang katawagan ng marami sa lote na ibinibenta sa murang halaga, dahil walang development na ipatutupad at hindi naayon sa batas ng gobyerno ang paraan ng bentahan o transaction.

Installment - mayroong batas na nagtatakda para sa installment ng nabiling real estate sa Pilipinas na umiiral at may bisa pa rin hanggang sa ngayon.

Subdivision Project - ito ang scheme ng lote na ibinibenta batay sa cutting na 100 square meters (more or less) na karaniwang ipinakikita ng mga sellers sa kanilang mga buyers ng lote na kadalasan ay saklaw ng kabuuang ektarya o higit pa.

Irrigated/Irrigable Lands - iwasan ang pagbili ng mga "raw lots" na sakop nitong irrigated/irrigable lands dahil non-negotiable for conversion ang mga lupang nasa ganitong klasipikasyon o hindi pinahihintulutan ng batas na ito ay gawing isang pamayanan o residential community.

Pagpapatitulo - kung galing sa isang scheme subdivided lots or "raw lots" ang nabili ay dadaan pa rin ito at dapat idaan pa rin sa sa tamang proseso ang bentahan kung tawagin DEVELOPMENT na itinatadhana ng batas bago ito maililipat sa pangalan ng mismong buyer ng lote.

Para protektahan ang mga buyers sa nakakatukso murang halaga ng lote ay maaaring sangguniin ang RA 9646, PD 957, BP 220, RA 6657 at ibang administrative orders at applicable na batas kaugnay ng isinasagawang subdivision project o maaring kumunsulta sa isang licensed/registered Real Estate Practitioner bago bumili ng lote na pinapangarap.

DAR Administrative Order No. 20, Series of 1992

*Protected Agricultural Lands: Identifies specific categories of agricultural lands that are protected from conversion, including:
*Irrigated Lands: Lands with existing irrigation facilities.
*Irrigable Lands: Lands that are scheduled for irrigation or can be converted to irrigated lands.
*Lands with Agro-Forestry Projects: Areas with ongoing agro-forestry projects.
*Lands Identified for Food Security: Areas designated for food production to ensure national food security.

DAR Administrative Order No. 1, Series of 2002
*Further Clarifications: This order provides further clarifications and updates on the guidelines for the conversion of agricultural lands, reinforcing the protection of irrigated and potentially irrigable lands.
*Stricter Requirements: Establishes stricter requirements for the conversion of agricultural lands to non-agricultural uses, emphasizing the protection of irrigated lands.

DAR Administrative Order No. 7, Series of 2011
*Updated Guidelines: Updates and consolidates previous guidelines on land use conversion.
*Identification of Non-Negotiable Lands: Reaffirms the non-negotiability of specific categories of agricultural lands, including:
*Irrigated and Irrigable Lands: Lands with existing or potential irrigation systems.
*Lands within Strategic Agriculture and Fisheries Development Zones (SAFDZ): Areas identified as critical for agriculture and fisheries development.
*Agro-Industrial and Agro-Forestry Zones: Lands designated for agro-industrial and agro-forestry purposes.

Beware of the word “Clean Title”.

You can only call it clean title IF;

⭕ Owners that appears in the title of the property are still ALIVE & CAN SIGN documents
⭕ NO disputes attached in the title AND “certified true copy” of the title.
Please take note of the “AND” because not all disputes are printed in the original title itself. Thus, it is very important to request for the latest certified true copy of the title.
⭕ All real estate taxes are paid on time. Always request for latest real estate tax clearance.
⭕ The owners are married (on or after 1987) The property is considered conjugal even if only one property owner is in the title. Both should sign sale documents. Should the property owner dies, heirs should file and pay for the estate tax of all the properties.
⭕ The property estate taxes are not yet paid, the property cannot be called “CLEAN”.
⭕ Magkaiba po ang real estate tax na binabayaran ninyo annually at ang estate tax (BIR FORM 1801) You only pay estate tax if the owner in the title is already dead. Penalties (like big penalties) apply for late filing.

Public service lang po 🙂. Ang estate tax clearance po is NON-NEGOTIABLE. Kailangan talaga syang e file at bayaran whether you like it or not, pag namatay ang owner na nakalagay sa title
