A good case on Article 8 immigration claims. It is now settled that there are only two stages in Article 8 analysis - under the rule and freestanding/freewheeling Article 8. There is no longer requirement for an intermediate "arguability" filtering stage. Izuazu remains good law, whilst Gulshan is a bad law, in relation to approaches to consideration of Article 8 claims. In Intentional Law, a “People” is entitled to both Internal and External Self-Determination, whereas “Indigenous People” and “Minority” are entitled only to Internal Self-Determination. In other words, the right to External Self-Determination’ (Secession) inheres only in ‘Peoples’ (and not in ‘Minorities’ or ‘Indigenous Peoples’), particularly as Indigenous Peoples and Minorities are considered to occupy non-dominant positions, and are numerically inferior, in the state they belong.

A good case on the vexed issue of automatic qualification as a British Citizen with Right of Abode, on 1st January 1983, by those born in the former British colonies/protectorates. I successfully argued the Applicant's case at the Immigration & Asylum Chambers of the First-tier and Upper Tribunals respectively.
